Agreement to Terms

By accessing or using ghomryonphral.world, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the website or use our services.

Consumer Rights (Netherlands and EU)

If you are a consumer (an individual acting for purposes outside your trade, business, craft or profession), you have mandatory rights under Dutch and European law that cannot be limited by these terms. These include rights under the Consumer Rights Directive and Dutch law (Burgerlijk Wetboek, including the rules on distance and off-premises contracts where applicable). For custom-made goods made to your specifications, the right of withdrawal may not apply once performance has begun with your prior consent. We will inform you clearly before you place an order if that is the case. Nothing in these Terms affects your statutory rights as a consumer.

Services Description

Ghomryonphral provides custom clothing decoration services including patches, embroidery, and appliques. We create custom designs based on client specifications and produce them using professional techniques and materials.

Orders and Pricing

All orders are subject to acceptance by Ghomryonphral. Prices are quoted in Euros and do not include shipping unless otherwise stated. We reserve the right to modify prices without prior notice for new orders.

A deposit may be required for custom orders. Production begins after deposit receipt and design approval. Full payment is due before shipping.

Custom Design Work

When submitting designs for production, you warrant that:

• You own or have rights to use the submitted artwork
• The design does not infringe on any third-party intellectual property
• The design does not contain illegal or prohibited content

We reserve the right to refuse any order that we believe violates these terms or any applicable laws.

Production and Delivery

Production times vary based on order complexity and quantity. Estimated delivery times are provided at the time of quote and are not guaranteed. Delays may occur due to factors beyond our control.

Risk of loss passes to you upon delivery to the shipping carrier. We recommend purchasing shipping insurance for valuable orders.

Sample Approval

For custom orders, we provide a digital mockup or physical sample for approval before full production. Once approved, the design is considered final. Changes after approval may incur additional costs and delays.

Quality Assurance

We inspect all products before shipping. Minor variations in thread color, dimensions, or positioning may occur due to the nature of embroidery and are considered acceptable within industry standards.

Intellectual Property

All content on ghomryonphral.world, including text, graphics, logos, and images, is the property of Ghomryonphral or its content suppliers and is protected by copyright laws.

You retain ownership of your submitted designs. By submitting designs, you grant us a license to use them for order fulfillment and, with your permission, for portfolio purposes.

Limitation of Liability

Ghomryonphral shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific order in question.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Rotterdam, Netherlands, except where mandatory consumer law requires otherwise.

Dispute Resolution

If you are a consumer in the European Union, you may seek out-of-court dispute resolution. The European Commission provides information on consumer redress and a list of certified dispute resolution bodies in the Member States. You can also contact your local European Consumer Centre for cross-border disputes. We are not obliged to participate in such procedures but will consider them in good faith.

Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting. Your continued use of the website constitutes acceptance of modified terms.
